Commissioner Bill Dwyer presided with Commissioners Bobby Green, Sr., Hugh Massengill, Barbara Moorehouse, Anna Morrison, Peter Sorenson and Faye Stewart present.County Administrator Bill Van Vactor, County Counsel Teresa Wilson and Recording Secretary Melissa Zimmer were also present.












a. ORDER 06-4-5-1H/In the Matter of Approving Contract 06-C-0026 for Construction Manager/General Contractor (CM/GC) Services with Meili Construction for the Turtle Creek Affordable Housing Development in Eugene.


Jim McCoy, HACSA, explained that Turtle Creek is a proposed 27-unit tax credit finance project.He said they are finalizing their development team.He said they carried out RFPs and Meili Construction and Architectural Services submitted the best proposals.


Morrison asked for a list of who the other bidders were and the amounts they bid.


MOTION: to approve ORDER 06-4-5-1.


Morrison MOVED, Green SECONDED.


VOTE: 7-0.


b. ORDER 06-4-5-2H/In the Matter of Approving Contract 06-S-0025 for Architectural Services for the Turtle Creek Affordable Housing Development in Eugene, Oregon.


MOTION: to approve ORDER 06-4-5-2H.


Morrison MOVED, Green SECONDED.


VOTE: 7-0.


c. ORDER 06-4-5-3H/In the Matter of Approving Contract 06-S-0027 for Architectural Services for the New Winds Apartments in Florence.


McCoy stated that this was revisiting a board order that was approved in September 2005.He said the board order approved a different architectural firm.He indicated since that time they had been unable to finalize a contract with that firm.He said they went to their number two choice.He indicated the board order authorizes them to enter into a contract with their number two choice.


MOTION: to approve ORDER 06-4-5-3H.


Green MOVED, Morrison SECONDED.


VOTE: 7-0.


d. ORDER 06-4-5-4H/In the Matter of Amending the Agency's Procurement Policy.


Dorothy Cummings, HACSA, stated this is to bring their Procurement Policy into alignment with Lane Manual.She said the Lane Manual board order was submitted in December to make the changes to the statute that became effective January 1.She noted the big change was bringing the bid security performance and payment bonding from $50,000 to $100,000. She indicated the intent to award process under the RFP was an issue before the Lane County Commissioners but the rule had been written and it made it a two-step protest process.She added that it is a one step process and could come directly to the Board.She said that BOLI didnít have a residential rate.She said it might affect the building of low-income housing.She said they included the language but doesnít know how it would be in the future.


MOTION: to approve ORDER 06-4-5-4H.


Green MOVED, Stewart SECONDED.


Cummings recalled that Moorehouse brought up an issue in the RFP that had older language regarding the ability to not follow all of the procedures they laid out.She said it was a board issue.She noted that only the board could change those procedures.She added the County has other rule changes coming and Trina Laidlaw, Assistant County Counsel, would do a review to see if she could clean the language up and bring it to the Board to discuss.


VOTE: 7-0.
