Commissioner Bill Fleenor presided with Commissioner Rob Handy, Pete Sorenson and Faye Stewart present.  Bill Dwyer was excused County Administrator Jeff Spartz, County Counsel Liane Richardson and Recording Secretary Melissa Zimmer were also present.

 

8. PUBLIC HEARINGS

 

a. SECOND READING AND PUBLIC HEARING/Ordinance 6-09/In the Matter of Amending Chapter 7 of Lane Code to Revise Definitions and Add Sections Relating to Animal Services (LC 7.005-7.100, 7.110, 7.120-7.130, 7.140, 7.151-7.170) (NBA & PM 12/9/09).

 

Commissioner Fleenor opened the Public Hearing.

 

David Calderwood, Eugene, stated he was the Chair of the licensing codes and limits subcommittee from the LCAS advisory group.  He said he went over this word for word carefully and asked questions.  He said the committee endorses all the changes.  He reported they made a motion that this should be accepted and be sent to the Board.

 

Karen Gaffney, Health and Human Services, indicated that the LCAS Advisory Committee hadnít seen the changes on dangerous behavior of dogs. 

 

Bernie Perkins, LCAS, thought the language was important to put in.  He noted when there is a violation on dangerous behavior; the fine could be directed toward the person who is doing caretaking with the animal.

 

There being no one else signed up to speak, Commissioner Fleenor closed the Public Hearing.

 

Gaffney noted there were also some small housekeeping items.  She said they were updating the code for LCAS.

 

MOTION: to adopt Ordinance 6-09.

 

Handy MOVED, Stewart SECONDED.

 

ROLL CALL VOTE: 4-0.

 

9.  PUBLIC WORKS

 

a.  ORDER 10-1-6-17/In the Matter of Appointing Representative to the Forum on an Area Commission Transportation for Lane County (FACT-LC)

 

Celia Barry, Public Works, reported this was a supplement item to Board Order 09-12-2-16 to form an ACT for Lane County.  She indicated that they need to appoint either a commissioner or someone from the County at large.  She added that they need a primary commissioner and an alternate appointee.

 

MOTION: to approve ORDER 10-1-6-7 with Handy as the primary commissioner and Stewart as the designated alternate.

 

Stewart MOVED, Handy SECONDED.

 

VOTE: 4-0.

 

b. ORDER 10-1-6-13/In the Matter of Appointing one Member to the Lane County  

Planning Commission

 

MOTION: that this matter be rolled for one month.

 

Handy MOVED, Sorenson SECONDED.

 

Stewart asked if John Sullivan was still on the Planning Commission.

 

Richardson explained that Sullivan will be held over until they get another appointee.

 

Stewart indicated that Sullivan is in an at-large position, not one of five appointed by the Board.  He noted that Sullivan was unanimously recommended by the Planning Commission.  He was willing to give Sullivan an extra month on the committee.

 

MOTION: to grant John Sullivan a 30 day extension for serving time on the Planning Commission.

 

Handy MOVED, Sorenson SECONDED.

 

VOTE: 4-0.

 

10. HUMAN RESOURCES

 

a. ORDER 10-1-6-15/In the Matter of Adopting a New Compensation and Classification Plan for Staff in the Assistant County Counsel Classifications.

 

Hector Rios, Human Resources, stated the Board requested review of the Classification and Comp Plan for Assistant County Counsel staff.  He reviewed the compensation for the Assistant County Counsel staff.  He said an adjustment was warranted as there was internal inequity.  He looked at similar classifications in other counties and Lane County was below market in compensation from other counties of about 18 percent.  He recommended adopting a new classification system.

 

MOTION: to approve ORDER 10-1-6-15.

 

Handy MOVED, Sorenson SECONDED.

 

Fleenor asked how this would impact the budget.

 

Richardson responded that they have sufficient funds.  She commented it would be tight, but they are watching expenditures so they donít have to submit a supplemental budget.

 

VOTE: 4-0.
