BOARD OF COMMISSIONERS' REGULAR MEETING
Harris Hall Main Floor - 1:30 p.m.

Commissioner Steve Cornacchia presided with Commissioners Ellie Dumdi, Bobby Green, Sr., Peter Sorenson present. Cindy Weeldreyer was late. Acting County Administrator David Garnick, Assistant County Counsel Stephen Vorhes and Recording Secretary Melissa Zimmer were also present.

4. PUBLIC WORKS

Note: These items carried over from the morning meeting.

a. THIRD READING AND DELIBERATION Ordinance No. PA 1121 Amending Lane County General Plan Policies (an element of the Lane County Rural Comprehensive Plan) Goal 4 Forest Lands, Policy 5 to Allow Limited Dwellings on Lands Zoned Non- Impacted Forest Lands, F-1 and Adopting a Savings and Severability Clause. (NBA & PM 9/23/98, 10/14/98 & 10/28/98) (Kent Howe and Jim Mann)

b. THIRD READING AND DELIBERATION Ordinance No. 4-98 Amending Chapter 16 of Lane Code to Adopt New Provisions to Allow Limited Dwellings on Lands Zoned Non-Impacted Forest Lands, F-1, and Provide Siting and Fire Safety Standards for Those New Dwellings, and Adopting a Savings and Severability Clause (LC 16.210, 16.270). (NBA & PM 9/23/98, 10/14/98 & 10/28/98). (Kent Howe & Jim Mann)

Cornacchia read the Third Reading and Deliberation Ordinance No. PA 1121 and Third Reading and Deliberation Ordinance No. 4-98 into the record.

MOTION: to approve the Third Reading and Setting Fourth Reading Ordinance No. PA 1121.

Dumdi MOVED, Green SECONDED.

Sorenson stated he wanted to discuss what came up at the Public Hearing. He said several people either in written or oral testimony talked about the need for a cost benefit study and he wanted to put on the record before this is pursued, that there be a cost benefit study.

VOTE: 3-1, Commissioner Sorenson dissenting.

MOTION: to approve the Third Reading and Setting Fourth Reading Ordinance No. 4-98.

Cornacchia MOVED, Dumdi SECONDED.

VOTE: 4-1, Commissioner Sorenson dissenting.

12. PUBLIC HEARINGS

a. PUBLIC HEARING AND FINAL ORDER 98-11-4-7 Surrender of County Road Number 439 (formerly Harlow Road) to the City of Springfield.

Bob Ezell, Public Works, reported this is a vintage road dating back to 1889, located in the Gateway area. He said in 1979 the road was reconstructed and altered by Lane County Public Works Department and at that time there was a plan to surrender this segment of road to the City of Springfield. He said he was contacted by the City of Springfield to do research to see if the road still existed and it does still exist as a County road. He said the City of Springfield wrote a letter to John Goodson, Public Works, requesting surrender. He added in 1986 there was an agreement that most of the County roads were transferred to the City of Springfield and it included Harlow Road. He added Harlow Road was surrendered in 1986 to the City of Springfield, but this segment was not. He said subsequently the City of Springfield sent a letter to John Goodson to surrender this road. He said Goodson recommended that it be surrendered and all appropriate notice has been given as required by statute.

Commissioner Cornacchia opened Public Hearing. With no one signed to speak, he closed Public Hearing.

MOTION: to approve ORDER 98-11-4-7.

Weeldreyer MOVED, Dumdi SECONDED.

VOTE: 5-0.

13. OTHER BUSINESS

None.

There being no further business, Commissioner Cornacchia adjourned the meeting at 1:40 p.m.
