Commissioner Anna Morrison presided with Commissioners Bill Dwyer, Bobby Green, Sr. and Peter Sorenson present. Cindy Weeldreyer excused. Assistant County Counsel Marc Kardell and Recording Secretary Melissa Zimmer were also present.
12. PUBLIC HEARINGS
a. PUBLIC HEARING AND FINAL ORDER 01-4-11-7/In the Matter of Surrender of a Portion of South 6th Street (County Road Number 538) to the City of Cottage Grove.
Bob Ezell, Land Management, explained this was a continuation of the December 13, 2000 meeting. He noted the Board deferred adoption of the order due to the wording in City Resolution 1366. He stated it went back to the City of Cottage Grove for City Resolution 1405, which changed the wording. He added the Board was concerned about the long-term expenditure of funds related to the surrender of roads to cities, and that the order directly spells out the financial obligation of the road surrender.
Ezell noted that the staff and director’s report states the overall cost of the County to the city would not increase, as it is fixed (there might be a slight increase if this surrender is approved to the City of Cottage Grove). He added the term of agreement provides for payment and accountability with the road fund money. He said there is a renewable clause and a provision for the County to amend the amount of the city to the County road partnership by providing 12-month notice to the city.
Ezell stated that John Goodson (Retired Director) Public Works and Craig Starr (Acting Director) recommended that the Board approve surrender of 6Th Street as proposed.
Green acknowledged that concerns were met with the surrender portion of the street.
Commissioner Morrison opened the Public Hearing. There being no one else signed up to speak, she closed the Public Hearing.
MOTION: to approve ORDER 01-4-11-7.
Green MOVED, Dwyer SECONDED.
