BOARD OF COMMISSIONERS' REGULAR MEETING
Harris Hall Main Floor - 1:30 p.m.

Chair Jerry Rust presided with Steve Cornacchia, Ellie Dumdi, Marie Frazier and Jack Roberts present. Sharon Giles, Recording Secretary.

12. PUBLIC HEARINGS

a. SECOND READING AND PUBLIC HEARING Ordinance PA 1059 Amending the Rural Comprehensive Plan to Redesignate Land from "Agriculture" to "Marginal Land," Rezoning that Land from "E-25/Exclusive Farm Use" to "ML/Marginal Land," Adopting Savings and Severability Clauses, and Declaring an Emergency (File PA 0795-94; Letsom).

Frazier presided briefly until Rust arrived at 1:34 p.m. Frazier read the Ordinance into the record. Michael Copely, Associate Planner, briefly reviewed this item (see material on file), distributing copies of recent correspondence. He displayed an overhead projection of the property in question.

Rust opened the Public Hearing.

Mike Evans, 1071 Harlow Road, Springfield, commented that he represents applicants Robert Miller and Steve Letsom. He briefly reviewed his clients' position (see material on file). Referring to Mrs. Lyman's letter distributed by Copely, Evans indicated that this process will not increase her taxes as she still has farm valuation and is taxed accordingly.

Rust closed the Public Hearing.

MOTION: Approval of the Ordinance. Frazier MOVED, Roberts SECONDED. The Secretary polled the Board.

VOTE: 5 Ayes.

b.  SECOND READING AND PUBLIC HEARING Ordinance PA 1060 Amending the Rural Comprehensive Plan to Redesignate Land from "Agriculture" to "Rural," Rezoning that Land from "E-40/Exclusive Farm Use" to "RR-5/Rural Residential 5," and Taking an Exception to Statewide Planning Goal 3, and Adopting Savings and Severability Clauses (File PA 0857-94; Parks).

Rust read the Ordinance into the record. Copely briefly reviewed this item (see material on file).

Rust opened the Public Hearing. There being no one present who wished to testify, Rust closed the Public Hearing. MOTION: Approval of the Ordinance. Roberts MOVED, Dumdi SECONDED. The Secretary polled the Board.

VOTE: 5 Ayes.

c.  PUBLIC HEARING The Tax Equity and Fiscal Responsibility Act of 1983 (TEFRA)/with Respect to the Issuance by Lane County (the "Issuer") of $6,500,000 Principal Amount of Revenue Bonds to Refinance its Pollution Control Bonds (Weyerhaeuser Company Project), Series A (the "Series 1975 Bonds").

Rust read the title into the record and opened the Public Hearing.

Doug Courson, bond counsel for Weyerhaueser, reviewed this item for the Board (see material on file).

There being no one else present who wished to testify, Rust closed the Public Hearing.

13. OTHER BUSINESS

a. RESOLUTION AND ORDER 94-8-10-23 Authorizing the Issuance and Sale of its Refunding Pollution Control Revenue Bonds (Weyerhaeuser Company Project), Series 1994 in the Principal Amount of $6,500,000; Approving the Documentation in Connection with the Issuance of Said Bonds; Appointing a Trustee; and Providing for Other Matters Relating Thereto.

MOTION: Approval of the Resolution and Order. Dumdi MOVED, Roberts SECONDED.

VOTE: 5-0.
