BOARD OF COMMISSIONERS' REGULAR MEETING
Harris Hall Main Floor - 1:30 p.m.

Chair Jerry Rust presided with Marie Frazier, Steve Cornacchia and Jack Roberts present. Ellie Dumdi excused. Beth McAllister, Recording Secretary.

Roberts announced that the Finance and Audit Committee would meeting at 9:00 a.m., July 22, 1994 to approve the form of note and borrowing utilized by the County.

11.    PUBLIC HEARINGS

a.    SECOND READING AND PUBLIC HEARING Ordinance No. PA 1052 Naming a Private Road Lee Lane.

MOTION: To approve the Ordinance. Roberts MOVED, Frazier SECONDED. The secretary polled the Board. VOTE: Frazier, Cornacchia, Roberts and Rust voted AYE.

12.    OTHER BUSINESS

a.    CONTINUED DISCUSSION, RESOLUTION AND FINAL ORDER 94-6-8-1 The Vacation of a Portion of East 43rd Street as Deeded in Book 236, Page 155, Lane County Oregon Deed Records (18-03-16).

Bob Ezell stated that on June 8th the Commissioner's recommended that the parties get together and come back to the board. He stated that as of today's date the parties have not come to any agreement. He noted that the Land's would be willing to donate the road if Egge would protect their water and electrical. He stated that Mr. Thorpe and his client, Egge, would go for a 30 day extension.

Frazier commented that she was under the assumption that public comment would be available this afternoon and that Cindy Land would be allowed to speak. Rust clarified that due to this being a quasi-judicial issue, public comment cannot take place.

Cindy Land stated that she would like to formally request a 30 day postponement. Jack Roberts asked if any progress had been made. Land stated that progress had been made in communication between the two parties. Roberts asked if she thought that with 30 more days if they would be further along. Land answered affirmatively. Cornacchia stated that he appreciated all those who have put this issue into writing. He stated that everything he has read has made him think that the vacation by itself is not to the public's benefit. He added that it is only fair for the Lands to expect and request payment for transfer of their property for other uses and to ask for protection of their power and water.

MOTION: To approve the 30 day postponement. Roberts MOVED, Rust SECONDED.

VOTE: 4-0. Rust stated that any additional material needed to be submitted on or before August 17, 1994.

b.    ORDER 94-7-20-23 Settling Claims of Ramona Shaw. MOTION: Approval. Cornacchia MOVED, Roberts SECONDED. VOTE: 4-0.

There being no further business, this meeting adjourned at 1:50 p.m.
