Filing an Appeal - Traffic:

If you are unhappy with the results of your trial at the Justice Court, you may file an Appeal with Circuit Court to have your case heard over again from the beginning.  There is a non-refundable fee that must be paid to Circuit Court when the paperwork is filed.  The fee is in the $200 range (currently $189).  Please contact Circuit Court about when and how the payment is due.

Appeal packets may be picked up from either of the cashiers at Central Lane Justice Court.  Your appeal must be filed at the Justice Court within thirty days of the judgment.  Do not wait beyond the thirty day period or you are outside of the appeal period.

The Justice Court will make a transcript of docket activities on your charges and forward them on to the Circuit Court with the original Appeal paperwork.   If you have already paid your fine, the fine will also be forwarded to Circuit Court.

Please note that if you entered a Guilty or No Contest plea, it will show on your record as a conviction.  The Justice of the Peace is required to take your plea and assign a fine.  There is no basis for appeal.

Appeal - Lane County Animal Services

If you have received an Animal conviction at trial, you may also file an appeal.  Please follow the guidelines listed above.  There is the same 30 day window of appeal.

Appeal - Small Claims/Civil

Small Claim/Civil appeals are similar as those listed above, but there is only a ten day period after Judgment that the appeal can be filed on a Small Claim.  Please note the 10 day restriction.  This is a very short window of appeal.  True civil cases have the 30 day appeal period.

Please note:   Justice Court staff may not give any legal advice.  This includes helping you fill out your forms.  Please follow the instructions to file, or seek legal counsel if you have questions.
