Building Program Permit Fee Refund Policy

The following refund policy applies to the Lane County Building, Electrical, Sanitation, and Erosion permits.


The Building Official is authorized to establish a refund policy per 109.6 OSSC and 108.5 ORSC.

The Lane Code 11.015(3) states the following:

All, or a portion, of the fee accompanying an application may be refunded, if the applicant withdraws the application in advance of permit issuance and prior to substantial staff review such as the initial plan review. A portion of the application fees may be retained to address the cost of refund processing. The amount of refund will be determined by the Building Official and will be based upon the proportion of staff time allotted to processing the permit relative to complete processing of a permit and refund. 

Refund Requests

A written request form is required for the cancellation and/or refund of a building permit. The request must be completed and received by Lane County within 180 days of the payment of the initial permit fees.

An expired permit is not eligible for fee refunds.

NOTE: Electrical permits are non-transferrable, per OAR 918-309-0000 (5).


Projects with an erosion prevention (EP) permit must also submit a Final Stabilization Form and additional plans and inspections may be required.

Eligible Refunds

  1. The jurisdiction may authorize the refunding of:
    1. Any fee not duly authorized.
    2. Fees paid for a permit under which no work has commenced, no plan review and/or inspections have been performed, subject to the limitation of subsection 2 of this section; and,
    3. Fees for a permit that has not been extended or has *expired.
  2. The jurisdiction may retain a portion of the total fees to cover **administrative costs for work already performed/provided.
  3. The jurisdiction may provide a full refund for fees applied in error by the jurisdiction.
*Permits are valid for 180 days after issuance. Permits may be extended upon request prior to expiration.

**Administrative Surcharges (15% of applicable fees) are non-refundable in addition to an hourly rate for processing.
